1. Acceptance of Terms
By downloading, installing, or using FortiFile, you agree to be bound by these Terms of Service.
2. Account Security & Encryption Keys
Critical Notice: You are solely responsible for maintaining the confidentiality of your account credentials. While FortiFile employs enterprise-grade encryption to protect your data, your encryption keys are intrinsically tied to your authentication. If you lose access to your account and recovery methods, your encrypted data may become permanently unrecoverable.
3. Acceptable Uploads & Content Ownership
You retain full ownership of the files you upload. However, you agree not to use FortiFile for prohibited purposes, including but not limited to:
- Violating any applicable national or international law.
- Infringing on intellectual property rights of others.
- Uploading malware, viruses, or malicious code.
Because FortiFile encrypts your content, we do not arbitrarily scan your files. Enforcement of these policies relies on user reports, automated diagnostics, and lawful warrants.
4. Tribes & Shared Content
FortiFile features "Tribes," which act as collaborative groups with role-based access. Group creators are fundamentally responsible for all content shared within their Tribes. Administrators have the right to revoke access or remove members. While shared files automatically inherit FortiFile's encryption mechanisms, robust access control and monitoring of tribe content remain the express responsibility of the Group Owner.
5. Account Termination & Data Deletion
You possess the right to permanently delete your account at any time through the platform controls.
- Irreversible Deletion: Account deletion is an irreversible action. Your underlying encrypted data immediately becomes unrecoverable.
- Termination for Violation: FortiFile reserves the right to suspend or terminate accounts found to be violating these Terms of Service.
6. Service Availability & Limitations
FortiFile provides its service on an "as-is" basis. We offer no guarantees regarding un-interrupted uptime. Storage limitations may apply, specific features may evolve, and free-tier access may be altered or discontinued with advanced notice.
7. Third-Party Services
FortiFile relies on secure third-party infrastructure to operate, including but not limited to Amazon Web Services (AWS) for secure scalable storage, and Google integration for functional routing (e.g. contact forms). By using FortiFile, you acknowledge our use of these specialized third-party sub-processors.
8. APK Sideloading & Updates
FortiFile distributes its Android application directly via APK download ("sideloading") rather than through the Google Play Store. Future system updates are fetched dynamically through our secure storage. You understand that distributing applications this way requires specific device permissions on your end, and you are solely responsible for accepting and installing prompt security patches to keep your app up-to-date.
9. Limitation of Liability
To the maximum extent permitted by law, FortiFile shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, goodwill, or other intangible losses resulting from your use of the service. This includes data loss arising from user negligence, lost credentials, or service interruptions.
10. Changes to These Terms
We reserve the right to modify these terms at our discretion. If we make material changes, we will notify you by updating the effective date at the top of this policy and, in some cases, providing an interface alert. Your continued use of FortiFile after the effective date constitutes your acceptance.
11. Governing Law
These Terms shall be governed by and construed in accordance with standard legal protocols applicable based on the jurisdiction of our operations, without regard to its conflict of law provisions.
